TERMS OF SERVICE

1. ACCEPTANCE OF TERMS

By accessing or using the services provided by OnHome ("OnHome," "we," "us," or "our"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and OnHome. If you do not agree to these Terms, you must not access or use our services.

By engaging with OnHome's services, whether through our website, email communications, consultations, or any other means, you acknowledge that you have read, understood, and agree to comply with these Terms in their entirety.

2. SERVICE DESCRIPTION

OnHome provides educational guidance and navigation services related to residential real estate transactions, including but not limited to:

Buyer Guidance: Information and education regarding the home purchasing process, including market navigation, understanding transaction steps, and guidance through the buying journey.

Seller Guidance: Information and education regarding the home selling process, including preparation strategies, understanding market conditions, and navigation through the selling journey.

Transaction Process Education: Comprehensive education about real estate transaction processes, timelines, documentation, and modern real estate practices.

Modern Real Estate Navigation: Contemporary approaches to understanding and navigating the real estate marketplace.

OnHome provides educational and informational services only. We do not:

- Act as licensed real estate agents or brokers

- Provide legal advice or legal services

- Provide financial advice or mortgage services

- Guarantee any specific outcomes in real estate transactions

- Represent you in negotiations or transaction closings

- Make property valuations or appraisals

Our services are designed to educate and guide users through the complexities of residential real estate transactions. Users are responsible for engaging appropriate licensed professionals, including real estate agents, attorneys, financial advisors, and inspectors, to complete actual real estate transactions.

3. USER OBLIGATIONS

By using OnHome's services, you agree to:

Provide accurate, current, and complete information during all interactions with OnHome, including but not limited to contact information, property details, and relevant circumstances affecting your real estate needs.

Use the services only for lawful purposes and in compliance with all applicable federal, state, and local laws and regulations.

Maintain the confidentiality of any account credentials or access information provided to you by OnHome.

Not reproduce, duplicate, copy, sell, resell, or exploit any portion of OnHome's services, materials, or content without express written permission.

Not use OnHome's services to transmit any harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable material.

Not interfere with or disrupt the integrity or performance of OnHome's services or systems.

Engage licensed professionals, including real estate agents, attorneys, and other appropriate experts, for actual real estate transactions and legal matters.

Acknowledge that OnHome's guidance is educational in nature and does not replace professional real estate, legal, or financial services.

Respect the intellectual property rights of OnHome, including all content, materials, trademarks, and proprietary information.

4. APPOINTMENT SCHEDULING AND CANCELLATIONS

Scheduling: Appointments for guidance sessions may be scheduled through the contact information provided or through any scheduling system made available by OnHome. Availability is subject to change, and appointment requests are not confirmed until you receive a confirmation from OnHome.

Cancellations by User: If you need to cancel or reschedule an appointment, you must provide notice to OnHome at least 24 hours in advance of the scheduled appointment time. Cancellations made with less than 24 hours notice or failure to appear for a scheduled appointment ("no-show") may result in forfeiture of any fees paid or assessment of cancellation fees as applicable.

Rescheduling: Appointment rescheduling requests are subject to availability. While we will make reasonable efforts to accommodate rescheduling requests, we cannot guarantee that alternative times will be available within your preferred timeframe.

Cancellations by OnHome: OnHome reserves the right to cancel or reschedule appointments due to unforeseen circumstances, scheduling conflicts, or other operational needs. In such cases, we will make reasonable efforts to notify you as soon as possible and offer alternative appointment times. If a mutually agreeable alternative cannot be arranged and OnHome cancels your appointment, any fees paid for that specific appointment will be refunded.

Late Arrivals: If you arrive late to a scheduled appointment, the appointment may be shortened to accommodate other scheduled commitments, or may be treated as a cancellation subject to the cancellation policy outlined above.

5. PAYMENT TERMS

Service Fees: Certain OnHome services may require payment of fees. All applicable fees will be communicated to you prior to your engagement of such services. By proceeding with services that require payment, you agree to pay all fees as specified.

Payment Methods: Payment must be made through the methods accepted by OnHome, which may include credit card, debit card, electronic payment platforms, or other methods as specified. You are responsible for ensuring that your payment information is current and accurate.

Payment Timing: Unless otherwise specified, payment is due at the time services are scheduled or rendered. OnHome reserves the right to require advance payment for services.

Non-Payment: Failure to pay fees when due may result in suspension or termination of services. OnHome reserves the right to pursue collection of outstanding amounts, and you agree to be responsible for all costs of collection, including reasonable attorney fees.

Refunds: Refund eligibility depends on the specific service purchased and the circumstances of the request. Refund requests must be submitted in writing to Savannah.Lane@onhome.info. OnHome will evaluate refund requests on a case-by-case basis. Generally, refunds will not be provided for services already rendered or for cancellations made with less than 24 hours notice.

Price Changes: OnHome reserves the right to modify service fees at any time. Price changes will not affect services already purchased or scheduled prior to the effective date of the price change.

No Refunds for Third-Party Services: OnHome is not responsible for refunding fees paid to third parties, including but not limited to real estate agents, attorneys, inspectors, or other professionals you may engage.

6. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, OnHome and its owners, officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

Your access to or use of or inability to access or use OnHome's services.

Any conduct or content of any third party in connection with the services.

Any content obtained from the services.

Unauthorized access, use, or alteration of your transmissions or content.

Any real estate transaction outcomes, including but not limited to financial losses, failed transactions, property condition issues, or disputes with other parties.

Decisions made based on information or guidance provided by OnHome.

Actions or omissions of third-party professionals you engage, including real estate agents, attorneys, lenders, or inspectors.

In no event shall OnHome's total liability to you for all damages, losses, or causes of action exceed the amount you have paid to OnHome for services in the six months prior to the event giving rise to the liability, or one hundred dollars ($100), whichever is greater.

OnHome provides educational and informational services only. You acknowledge that real estate transactions involve significant financial commitments and risks, and you assume all responsibility for decisions made regarding real estate transactions.

The limitations and exclusions in this section apply regardless of the theory of liability, whether based on contract, tort (including negligence), strict liability, warranty, or any other legal theory, and whether or not OnHome has been informed of the possibility of such damage.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you. In such jurisdictions, OnHome's liability will be limited to the greatest extent permitted by law.

7. WARRANTY DISCLAIMERS

OnHome's services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

OnHome does not warrant that:

The services will meet your specific requirements or expectations.

The services will be uninterrupted, timely, secure, or error-free.

The information, guidance, or content provided through the services will be accurate, reliable, complete, or current.

Any defects or errors in the services will be corrected.

The services will result in successful real estate transactions or favorable outcomes.

Information provided is comprehensive or covers all aspects relevant to your specific situation.

OnHome does not warrant or make any representations regarding the use or the results of the use of the services in terms of their correctness, accuracy, reliability, or otherwise. You assume all risk for any damage to your computer system or mobile device, or for any loss of data that results from accessing or using the services.

Real estate markets are subject to numerous factors beyond OnHome's control, including economic conditions, local market dynamics, regulatory changes, and individual circumstances. OnHome makes no guarantees regarding real estate market conditions, property values, transaction timelines, or outcomes.

The guidance and information provided by OnHome is educational in nature and based on general principles and practices. It is not tailored legal advice, financial advice, or professional real estate services. You are solely responsible for engaging appropriate licensed professionals for your specific needs.

No oral or written information or advice given by OnHome or its representatives shall create a warranty not expressly stated in these Terms.

8. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless OnHome and its owners, officers, employees, agents, affiliates, and partners from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising from:

Your use of or access to OnHome's services.

Your violation of these Terms.

Your violation of any third-party rights, including intellectual property rights, privacy rights, or property rights.

Any decisions you make or actions you take based on information or guidance received from OnHome.

Any real estate transactions you enter into or attempt to enter into.

Any disputes between you and third parties, including real estate agents, sellers, buyers, lenders, or other parties involved in real estate transactions.

Any misrepresentation or omission of information you provide to OnHome.

This indemnification obligation will survive termination of these Terms and your use of OnHome's services.

9. INTELLECTUAL PROPERTY

All content, materials, information, and intellectual property provided through OnHome's services, including but not limited to text, graphics, logos, images, videos, audio, software, data compilations, and the design and layout of materials, are owned by or licensed to OnHome and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use OnHome's services and materials solely for your personal, non-commercial use in connection with receiving guidance regarding residential real estate transactions.

You may not:

Reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material from OnHome's services, except as incidentally necessary for normal use of the services or as expressly permitted in writing by OnHome.

Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices from materials originating from OnHome's services.

Use any data mining, robots, scraping, or similar data gathering or extraction methods in connection with the services.

Attempt to gain unauthorized access to any portion of the services or any systems or networks connected to the services.

The OnHome name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of OnHome. You may not use such marks without the prior written permission of OnHome.

10. PRIVACY AND DATA PROTECTION

OnHome respects your privacy and is committed to protecting your personal information. By using our services, you consent to the collection, use, and disclosure of your information as described in our Privacy Policy, which is incorporated into these Terms by reference.

You acknowledge that information you provide to OnHome may include sensitive financial and personal information. While we implement reasonable security measures to protect your information, no method of transmission over the internet or electronic storage is completely secure. You provide information at your own risk.

OnHome will not sell your personal information to third parties. However, we may share information with service providers who assist in delivering our services, subject to confidentiality obligations.

11. CONFIDENTIALITY

OnHome acknowledges that during the course of providing services, you may share confidential information regarding your financial situation, real estate goals, property details, and personal circumstances. OnHome agrees to maintain the confidentiality of such information and will not disclose it to third parties except:

As required by law or legal process.

To service providers who assist OnHome in delivering services, subject to confidentiality obligations.

When necessary to protect OnHome's legal rights or defend against legal claims.

You acknowledge that general information about real estate practices, market conditions, and transaction processes discussed during your engagement with OnHome may not be considered confidential.
